Costs decision was a “knockout”

April 9, 2013   ·   0 Comments

It is a relief that the insurance company of the Town of Aurora, in the defence action of our former mayor, Mrs. Phyllis Morris vs. Mr.
George Hervey, is going to recover $50.850.00 in legal costs (including HST).
The Aurora property tax payers, no doubt, would otherwise have been facing a substantial premium increase.
Noteworthy is the astute observation of Ontario Supreme Court Justice Cory Gilmore that Mr. George Hervey’s failed action was, among others, politically rather than legally motivated.
In the end a costly knockout by the defence right hook.
